Need a Divorce Lawyer in Kent?
Unfortunately, marriages fail, and partners decide to sever ties. Married couples and civil partners both submit divorce petitions. According to the relevant laws, they are similar, and the process is essentially the same.
Getting a divorce or bringing the relationship to an end by nullity, a separation order, or a declaration of presumed death, will not always require legal advice.
The Courts will expect you both to try to and resolve any disputes before going to Court. This often requires our help with reaching an agreement about the distribution of assets and the future care of children.
If you find yourself on the wrong end of a divorce and are in need of some help, advice or solutions, Robinson Allfree would be happy to help.
Why get a Divorce Lawyer?
A divorce can quickly turn into a massive legal battle between two parties. The process and the potential for additional headaches can cause a significant amount of stress. Going through a divorce is hard, but it can be even more difficult when you don’t understand what is happening or any of the correct proceedings that should be taking place.
It is compulsory for you to attempt mediation. This means you must attend a Mediation Information and Assessment Meeting (MIAM). In most cases, mediation is cheaper than going to Court, and some couples will be entitled to legal aid to cover any costs.
If a resolution cannot be achieved, or the application is opposed, it is essential to seek legal advice.
Robinson Allfree is committed to helping our clients every step of the way. We can help simplify all of the complex jargon to make the process easier to understand. We can help with negotiations outside of court, as well as assisting with drafting important documents or handling court proceedings.
How to get a Divorce
To apply for a divorce, you must have been married for at least a year. The partner wanting to end the marriage is called the applicant. The grounds for this termination is that the relationship has irretrievably broken down.
Assuming the Judge accepts your court application, a Conditional Order will initially be granted. Then six weeks after that, the Judge will grant you the Final Order. The Final Order ends the marriage. However, on the granting of the divorce, each partner’s status in relation to any children remains the same.
We can also help you obtain the following Court Orders –
- Child arrangement order – setting out who the child lives with
- Contact order – setting out the parent with whom a child should live, visiting issues
- Prohibited steps order – stops another party from taking a specified action in relation to a child.
- Specific issue order – resolves specific issues, such as a child’s religious upbringing
On the granting of the divorce, the division of income and capital (& the value of pensions) will also be decided by the Court.
The Court tries to help you achieve a ‘clean’ break; we guide you with the steps of getting there.
